    Asia IBS Mexico is the entity responsible for processing the personal data collected through the asia-ibs.com website and the app.asiaibs.com customer portal.<\/p>\n\n

    For transactions involving clients or users located in other jurisdictions, Asia IBS works in coordination with its offices in Shanghai, Santiago, Chile, and Barcelona. Data may be processed by any of these offices as part of the provision of the contracted service. See Section 6 \u2014 International Transfers. <\/p>\n\n

    We collect only the information we need to respond to your request, provide you with the service, or keep you informed if you have given your consent to do so.<\/p>\n\n

      2.2 Through the insights (newsletter) subscription form<\/strong><\/h3>\n\n

        2.3 Through the customer portal at app.asiaibs.com<\/strong><\/h3>\n\n

        • Login credentials (username and encrypted password).<\/li>\n\n
        • Activity log within the portal (logins, downloads, queries).<\/li>\n\n

          2.4 Data We Collect Automatically<\/strong><\/h3>\n\n

          When you browse the site, we collect technical browsing information (IP address, device type, operating system, browser, pages visited, time spent on the site). See Section 8 \u2014 Cookies and Similar Technologies. <\/p>\n\n

          2.5 Sensitive Data<\/strong><\/h3>\n\n

          Asia IBS does not collect sensitive personal data as defined by the LFPDPPP (racial or ethnic origin, health status, genetic information, religious, philosophical, and moral beliefs, union membership, political opinions, sexual orientation). The Asia IBS service does not require this type of information. <\/p>\n\n

          3. Purposes of the processing<\/strong><\/h2>\n\n

          3.1 Primary Purposes (Necessary for the Legal Relationship)<\/strong><\/h3>\n\n

          • Respond to your contact request or “Schedule a Call” request.<\/li>\n\n
          • To send you quotes, business proposals, and answers to specific questions about our services.<\/li>\n\n
          • To provide the inspection, audit, and Quality Control services that your company contracts for.<\/li>\n\n
          • Provide you with access to and allow you to use the customer portal.<\/li>\n\n
          • To comply with tax, accounting, and contractual obligations arising from the business relationship.<\/li>\n<\/ul>\n\n

            3.2 Secondary Purposes (require additional consent)<\/strong><\/h3>\n\n
              \n
            • To send you regular informational content (newsletters, articles, checklists, industry analyses).<\/li>\n\n
            • Invite you to Asia IBS webinars, events, or presentations.<\/li>\n\n
            • Conduct statistical studies and market research on the inspection industry.<\/li>\n\n
            • Customize marketing content based on your industry or region.<\/li>\n<\/ul>\n\n

              If you do not wish for your data to be processed for secondary purposes<\/strong>, you may indicate this at any time by sending an email to (email)<\/em>. Refusal to consent to these purposes will not affect the provision of the contracted services.<\/p>\n\n

              4. Legal Basis for Processing<\/strong><\/h2>\n\n

              • Mexico (LFPDPPP): Data processing <\/strong>is based on the data subject\u2019s consent and the need to fulfill the contractual relationship.<\/li>\n\n
              • Chile (Law 19.628): Data processing <\/strong>is carried out with the data subject\u2019s express consent or in fulfillment of a contractual relationship.<\/li>\n\n
              • Spain \/ EU (GDPR): The <\/strong>applicable legal bases are consent (Art. 6.1.a), the performance of a contract (Art. 6.1.b), and the legitimate interests of the data controller (Art. 6.1.f) for communication activities with current customers.<\/li>\n\n
              • China (PIPL): Data processing <\/strong>is carried out with the data subject’s consent in accordance with the requirements of Chinese law.<\/li>\n<\/ul>\n\n

                5. Retention Period<\/strong><\/h2>\n\n

                We retain your personal data for as long as necessary to fulfill the purposes for which it was collected:<\/p>\n\n

                • Business contact information (prospects): 24 <\/strong>months from the last active contact, unless you request deletion sooner.<\/li>\n\n
                • Customer data for customers with an active contractual relationship: for <\/strong>the entire term of the contract and for any additional period required by law\u2014typically 5 years in Mexico from the closing of the transaction. <\/li>\n\n
                • Newsletter subscriber data: until <\/strong>you unsubscribe.<\/li>\n\n
                • Customer portal data: for <\/strong>the duration of access, plus a reasonable period for backups and post-termination audits. <\/li>\n<\/ul>\n\n

                  Once these time periods have elapsed, the data is locked and subsequently securely deleted.<\/p>\n\n

                  6. International Transfers<\/strong><\/h2>\n\n

                  Since Asia IBS operates offices in Mexico, China, Chile, and Spain, and uses global technology tools to manage customer information, some personal data may be transferred to jurisdictions other than the country of origin.<\/p>\n\n

                  Currently available transfers:<\/strong><\/p>\n\n

                  • Among Asia IBS’s offices (Shanghai, Shenzhen, Qingdao, Ningbo, Hong Kong, Mexico City, Guadalajara, Monterrey, Quer\u00e9taro, Santiago, and Barcelona) for the coordinated provision of the service.<\/li>\n\n
                  • Technology providers that act as data processors (CRM tools, email, cloud storage, analytics, operational platform). <\/li>\n<\/ul>\n\n

                    These transfers are carried out with the following safeguards:<\/strong><\/p>\n\n

                    • Sign data processing agreements with each vendor.<\/li>\n\n
                    • Verification that suppliers provide an adequate level of protection in accordance with international standards.<\/li>\n\n
                    • For transfers to China, compliance with the requirements set forth in the PIPL.<\/li>\n\n
                    • For transfers from Spain to third countries, the Standard Contractual Clauses approved by the European Commission or equivalent mechanisms shall apply.<\/li>\n<\/ul>\n\n

                      7. Data Subject Rights (ARCO \/ GDPR \/ equivalents)<\/strong><\/h2>\n\n

                              Asia IBS operates under ISO\/IEC 27001:2022 <\/strong>certification for <\/strong>information security, which ensures that its data management processes comply with auditable international standards.<\/p>\n\n

                              However, no internet transmission or storage system is 100% secure. In the event of a security breach affecting personal data, Asia IBS will notify the affected data subjects and the competent authorities within the timeframes required by applicable law. <\/p>\n\n

                              10. Minors<\/strong><\/h2>\n\n

                              Asia IBS’s services are B2B (business-to-business). They are not intended for minors. We do not knowingly collect personal data from minors. If we discover that we have collected data from a minor without the consent of their guardians, we will delete it. <\/p>\n\n
