Asia IBS Mexico is the entity responsible for processing the personal data collected through the asia-ibs.com website and the app.asiaibs.com customer portal.
For transactions involving clients or users located in other jurisdictions, Asia IBS works in coordination with its offices in Shanghai, Santiago, Chile, and Barcelona. Data may be processed by any of these offices as part of the provision of the contracted service. See Section 6 — International Transfers.
2. Personal Information We Collect
We collect only the information we need to respond to your request, provide you with the service, or keep you informed if you have given your consent to do so.
2.1 Using the “Schedule a Call” form
- Full name.
- Corporate email.
- Name of the company you represent.
- Phone.
- The country where your company operates.
- Any information you choose to share in the message field.
2.2 Through the insights (newsletter) subscription form
- Name.
- Email.
- Company (optional).
- Area of interest (optional).
2.3 Through the customer portal at app.asiaibs.com
- User identification information (name, email address, job title).
- Login credentials (username and encrypted password).
- Activity log within the portal (logins, downloads, queries).
- Information related to the service contracts your company has entered into (inspection reports, photographic evidence, operational documentation).
2.4 Data We Collect Automatically
When you browse the site, we collect technical browsing information (IP address, device type, operating system, browser, pages visited, time spent on the site). See Section 8 — Cookies and Similar Technologies.
2.5 Sensitive Data
Asia IBS does not collect sensitive personal data as defined by the LFPDPPP (racial or ethnic origin, health status, genetic information, religious, philosophical, and moral beliefs, union membership, political opinions, sexual orientation). The Asia IBS service does not require this type of information.
3. Purposes of the processing
3.1 Primary Purposes (Necessary for the Legal Relationship)
- Respond to your contact request or “Schedule a Call” request.
- To send you quotes, business proposals, and answers to specific questions about our services.
- To provide the inspection, audit, and Quality Control services that your company contracts for.
- Provide you with access to and allow you to use the customer portal.
- To comply with tax, accounting, and contractual obligations arising from the business relationship.
3.2 Secondary Purposes (require additional consent)
- To send you regular informational content (newsletters, articles, checklists, industry analyses).
- Invite you to Asia IBS webinars, events, or presentations.
- Conduct statistical studies and market research on the inspection industry.
- Customize marketing content based on your industry or region.
If you do not wish for your data to be processed for secondary purposes, you may indicate this at any time by sending an email to (email). Refusal to consent to these purposes will not affect the provision of the contracted services.
4. Legal Basis for Processing
- Mexico (LFPDPPP): Data processing is based on the data subject’s consent and the need to fulfill the contractual relationship.
- Chile (Law 19.628): Data processing is carried out with the data subject’s express consent or in fulfillment of a contractual relationship.
- Spain / EU (GDPR): The applicable legal bases are consent (Art. 6.1.a), the performance of a contract (Art. 6.1.b), and the legitimate interests of the data controller (Art. 6.1.f) for communication activities with current customers.
- China (PIPL): Data processing is carried out with the data subject’s consent in accordance with the requirements of Chinese law.
5. Retention Period
We retain your personal data for as long as necessary to fulfill the purposes for which it was collected:
- Business contact information (prospects): 24 months from the last active contact, unless you request deletion sooner.
- Customer data for customers with an active contractual relationship: for the entire term of the contract and for any additional period required by law—typically 5 years in Mexico from the closing of the transaction.
- Newsletter subscriber data: until you unsubscribe.
- Customer portal data: for the duration of access, plus a reasonable period for backups and post-termination audits.
Once these time periods have elapsed, the data is locked and subsequently securely deleted.
6. International Transfers
Since Asia IBS operates offices in Mexico, China, Chile, and Spain, and uses global technology tools to manage customer information, some personal data may be transferred to jurisdictions other than the country of origin.
Currently available transfers:
- Among Asia IBS’s offices (Shanghai, Shenzhen, Qingdao, Ningbo, Hong Kong, Mexico City, Guadalajara, Monterrey, Querétaro, Santiago, and Barcelona) for the coordinated provision of the service.
- Technology providers that act as data processors (CRM tools, email, cloud storage, analytics, operational platform).
These transfers are carried out with the following safeguards:
- Sign data processing agreements with each vendor.
- Verification that suppliers provide an adequate level of protection in accordance with international standards.
- For transfers to China, compliance with the requirements set forth in the PIPL.
- For transfers from Spain to third countries, the Standard Contractual Clauses approved by the European Commission or equivalent mechanisms shall apply.

7. Data Subject Rights (ARCO / GDPR / equivalents)
As the data subject, you have the following rights:
- Right of Access: Find out what personal data we process about you and for what purpose.

- Deletion: Request the deletion of your data when it is no longer necessary for the purpose for which it was collected.
- Right to Object: To object to the processing of your data for a specific purpose.
- Data Portability (GDPR and equivalent jurisdictions): to receive your data in a structured format and transfer it to another data controller.
- Restriction of Processing (GDPR): Request a restriction on processing in specific cases.
- Withdrawal of Consent: You may withdraw your consent at any time, without retroactive effect.
- File a complaint with the supervisory authority in your jurisdiction (INAI in Mexico, the Council for Transparency in Chile, AEPD in Spain, CAC in China).

We will respond to your request within a maximum of:
- 20 business days in Mexico (LFPDPPP).
- 30 days in Spain (GDPR).
- The equivalent time limits applicable in Chile and China.

10. Minors
Asia IBS’s services are B2B (business-to-business). They are not intended for minors. We do not knowingly collect personal data from minors. If we discover that we have collected data from a minor without the consent of their guardians, we will delete it.
11. Changes to the Privacy Notice
This notice may be modified by Asia IBS at any time to reflect changes in operations, technology, or applicable laws. Any modifications will be posted on this page with a clear indication of the date of the last update.
